Terms of Use

1. Acceptance of Terms

By accessing or using the NutriTrack platform ("the Platform"), operated by Azania Digital Solutions (Pty) Ltd ("the Company"), you agree to be bound by these Terms of Use. If you are accessing the Platform on behalf of a school, district office or government department, you represent that you have the authority to bind that organisation to these terms.

These Terms of Use must be read together with our Privacy Policy and, where applicable, the End User Licence Agreement and Data Processing Agreement.

2. Description of Service

NutriTrack is a cloud-based management system for the National School Nutrition Programme (NSNP), enabling:

• Schools to submit feeding registers, delivery schedules, stock reports and monthly reporting packs
• District officials to receive, review and approve submissions from schools
• Department of Education officials to maintain oversight across districts
• Internal communication between all parties
• Supply tracking and incident reporting

3. User Registration & Access

3.1 School Users

• A maximum of three (3) users may be registered per school EMIS number
• All school user registrations are subject to approval by the relevant district administrator
• Users must provide accurate school and personal information at registration
• Access may be revoked by a district administrator at any time

3.2 District & Department Users

• District administrator and Department accounts are provisioned by the system developer
• These accounts carry elevated permissions and must only be used by authorised officials

3.3 Account Security

• You are responsible for maintaining the confidentiality of your username and password
• You must notify us immediately of any unauthorised use of your account
• You may not share your login credentials with any other person
• The Company is not liable for any loss arising from unauthorised account access caused by your failure to keep credentials secure

4. Acceptable Use

You agree to use the Platform only for its intended purpose — the administration of the NSNP. You must not:

• Submit false, misleading or fabricated data in any form or report
• Access data belonging to another school or district without authorisation
• Attempt to circumvent role-based access controls
• Use the Platform to store or transmit unlawful, defamatory or harmful content
• Attempt to reverse-engineer, decompile or copy any part of the Platform
• Use automated tools to scrape or extract data from the Platform
• Interfere with the security or integrity of the Platform or its servers

5. Data Accuracy & Responsibility

You are responsible for the accuracy and completeness of all data you submit through the Platform. The Company is not responsible for errors, omissions or decisions made on the basis of inaccurate data submitted by users.

By submitting a form, you confirm that the information contained therein is accurate to the best of your knowledge.

6. Intellectual Property

The NutriTrack platform, including its software, design, user interface, documentation and all content created by the Company, is the exclusive intellectual property of Azania Digital Solutions (Pty) Ltd, protected under the Copyright Act 98 of 1978 and applicable South African law.

The data submitted by users (school information, reports, feeding records) remains the property of the submitting organisation. The Company holds a licence to store and process that data solely for the purpose of providing the service.

Nothing in these Terms grants you any rights to copy, modify, distribute or create derivative works of the Platform.

7. Availability & Support

We aim to maintain Platform availability of 99% per month, excluding scheduled maintenance. Scheduled maintenance will be communicated at least 24 hours in advance where possible.

8. Limitation of Liability

To the maximum extent permitted by South African law, the Company shall not be liable for:

• Any indirect, incidental or consequential loss arising from use of the Platform
• Loss of data due to user error
• Decisions made by district or department officials based on information submitted through the Platform
• Service interruptions beyond our reasonable control (force majeure)

Our total liability to any client in any calendar year shall not exceed the total fees paid by that client in that year.

9. Termination

Either party may terminate access to the Platform with 30 days' written notice. On termination:

• The client may request an export of all their data within 30 days of termination
• After 30 days, data will be retained per our retention policy then securely deleted
• The Company reserves the right to terminate access immediately in cases of material breach, fraud or non-payment

10. Governing Law

These Terms of Use are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South Gauteng High Court, Johannesburg, unless the parties agree to alternative dispute resolution.

11. Changes to These Terms

We may update these Terms of Use from time to time. Registered users will be notified of material changes via the platform. Continued use of the Platform after the effective date of the updated Terms constitutes acceptance.
